    1. Agreement to Terms

    By accessing or using Workbench ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

    2. Description of Service

    Workbench is a software-as-a-service platform designed for jewelry businesses to manage inventory, track orders, generate certificates, calculate pricing, and perform other business management functions. The Service is provided by Workbench Pro ("Company", "we", "us", or "our").

    3. Account Registration

    To use the Service, you must:

    • Provide accurate, current, and complete information during registration
    • Maintain and update your account information to keep it accurate
    • Maintain the security of your account credentials
    • Accept responsibility for all activities under your account
    • Notify us immediately of any unauthorized access

    4. Subscription Plans and Billing

    Workbench offers subscription plans with different features and limits:

    • Starter Plan: $129/month - Includes inventory management, client management (CRM), scrap value calculator, repair valuation tool, and metal rate tracker. Limited to 500 inventory items, 200 clients, and 100 library files.
    • Professional Plan: $329/month - Includes all Starter features plus jewelry authenticity card generation, order management, personalized nameplate studio, and payment processing. Limited to 2,500 inventory items, 1,000 clients, and 500 library files.
    • Enterprise Plan: Custom pricing - Includes all Professional features with unlimited inventory items, clients, and library files, plus custom integrations, dedicated support, and white-label options.

    Subscriptions are billed monthly in advance. All fees are non-refundable except as required by law. You may cancel your subscription at any time, and cancellation will take effect at the end of your current billing period.

    5. Acceptable Use

    You agree not to:

    • Use the Service for any illegal purpose or in violation of any laws
    • Transmit any harmful code, viruses, or malicious software
    • Attempt to gain unauthorized access to the Service or related systems
    • Interfere with or disrupt the Service or servers
    • Copy, modify, or create derivative works of the Service
    • Reverse engineer, decompile, or disassemble the Service
    • Use the Service to compete with or harm our business

    6. Intellectual Property

    The Service, including all content, features, and functionality, is owned by Workbench Pro and protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks, logos, or other proprietary information without our prior written consent.

    7. User Content

    You retain ownership of all data and content you upload to the Service ("User Content"). By uploading User Content, you grant us a license to use, store, and process it solely to provide the Service. You represent that you have all necessary rights to upload User Content and that it does not violate any third-party rights.

    8. Data Security and Privacy

    We implement reasonable security measures to protect your data. However, no method of transmission over the internet is 100% secure. You are responsible for maintaining the confidentiality of your account credentials. Please review our Privacy Policy for information on how we collect and use your data.

    9. Service Availability

    We strive to maintain high availability but do not guarantee uninterrupted or error-free service. We may perform scheduled maintenance with reasonable notice. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

    10. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORKBENCH PRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

    11. Indemnification

    You agree to indemnify and hold harmless Workbench Pro from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

    12. Termination

    We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately, and we may delete your account and data.

    13. Changes to Terms

    We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

    14. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Workbench Pro operates, without regard to its conflict of law provisions.
